ORDER

 

WHEREAS on August 31, 2022, the Capital Markets Tribunal held a hearing by videoconference to schedule certain steps in this proceeding;

ON HEARING the submissions of the representatives for Staff of the Ontario Securities Commission (Staff) and for Oscar Furtado, with no one appearing for the other respondents;

IT IS ORDERED THAT:

  1. by September 22, 2022, the respondents shall serve and file a motion, if any, regarding Staff’s disclosure or seeking disclosure of additional documents and, by September 29, 2022, the parties shall either provide the registrar with an agreed schedule for any such motion or advise the registrar of mutually agreeable dates for an attendance to set a schedule for the motion;
  2. by November 23, 2022, the respondents shall:
    1. serve and file their witness lists;
    2. serve on Staff a summary of each witness’s anticipated evidence; and
    3. indicate any intention to call expert witnesses, including providing the experts’ names and the issues on which the experts will give evidence; and
  3. a further attendance in this matter will be heard at 10:00 a.m. on December 20, 2022 by videoconference, or on such other date and time as may be agreed to by the parties and set by the Governance & Tribunal Secretariat.
