ORDER

WHEREAS on January 27 and 28, 2021, the Ontario Securities Commission held a hearing by videoconference in relation to the application brought by Joseph Debus (Debus) (the Application) to review the decisions of the Investment Industry Regulatory Organization of Canada (IIROC) dated March 18, 2019 and June 25, 2019;

ON HEARING the Application and on hearing the submissions of the representatives for Debus, IIROC Staff and Staff of the Commission;

IT IS ORDERED THAT:

  1. Debus’s reasonable apprehension of bias motion is scheduled for February 19, 2021 at 10:00 a.m., by videoconference, or on such other date or time as may be agreed to by the parties and set by the Office of the Secretary; and
  2. the Parties shall adhere to the following timeline for the delivery of materials for the motion:
    1. Debus shall serve and file the motion and motion record by 4:30 p.m. on February 9, 2021;
    2. IIROC Staff and Staff of the Commission shall each serve and file any responding affidavits by 4:30 p.m. on February 12, 2021;
    3. Debus shall serve and file any reply affidavits and a memorandum of fact and law by 4:30 p.m. on February 16, 2021; and
    4. IIROC Staff and Staff of the Commission shall each serve and file a memorandum of fact and law by 12:00 p.m. on February 18, 2021.
