ORDER
WHEREAS on April 14, 2023, the Capital Markets Tribunal held a hearing by videoconference to schedule two motions brought by Staff of the Ontario Securities Commission (Staff) to: (1) compel further witness summaries from David Sharpe and Natasha Sharpe; and (2) dismiss the stay motions of David Sharpe and Natasha Sharpe;
ON HEARING the submissions of the representatives for each of Staff, David Sharpe, Natasha Sharpe, the receiver of Bridging Finance Inc., and Andrew Mushore;
IT IS ORDERED, for reasons to follow, that:
- Staff’s motion for further witness summaries from David Sharpe and Natasha Sharpe shall be heard by videoconference at 10:00 a.m. on May 23 and 26, 2023, or on such other date and time as may be agreed to by the parties and set by the Governance & Tribunal Secretariat;
- materials for Staff’s motion for further witness summaries shall be delivered as follows:
- David Sharpe and Natasha Sharpe shall each serve and file a responding motion record, if any, by 4:30 p.m. on April 21, 2023;
- Staff shall serve and file a reply record, if any, and written submissions, by 4:30 p.m. on May 3, 2023;
- each respondent shall serve and file responding written submissions, if any, by 4:30 p.m. on May 17, 2023; and
- Staff’s reply submissions, if any, shall be heard orally at the hearing of the motion;
- Staff’s motion to dismiss the stay motions of David Sharpe and Natasha Sharpe shall be treated as having been withdrawn;
- the stay motions of David Sharpe and Natasha Sharpe shall be heard by videoconference at 10:00 a.m. on May 23 and 26, 2023, or on such other date and time as may be agreed to by the parties and set by the Governance & Tribunal Secretariat;
- materials for David Sharpe’s and Natasha Sharpe’s motions shall be delivered as follows:
- David Sharpe and Natasha Sharpe shall serve and file by 4:30 p.m. on April 21, 2023, written submissions that:
- identify the witnesses for whom they wish to have summonses issued in support of their stay motions;
- describe the topics anticipated to be covered by each witness; and
- address the reasons they seek each witness’s testimony;
- Staff shall serve and file responding materials, if any, and written submissions, by 4:30 p.m. on April 28, 2023;
- David Sharpe and Natasha Sharpe shall serve and file written reply submissions, if any, by 4:30 p.m. on May 3, 2023;
- Natasha Sharpe shall serve and file the record for her motion for a stay, by 4:30 p.m. on May 12, 2023;
- Staff, Andrew Mushore and the receiver of Bridging Finance Inc. shall each serve and file a responding motion record, if any, by 4:30 p.m. on May 15, 2023;
- David Sharpe and Natasha Sharpe shall serve and file a reply record, if any, and written submissions, by 4:30 p.m. on May 16, 2023;
- Staff, Andrew Mushore and the receiver of Bridging Finance Inc. shall each serve and file responding written submissions, if any, by 4:30 p.m. on May 18, 2023; and
- David Sharpe’s and Natasha Sharpe’s reply submissions, if any, shall be heard orally at the hearing of the motion.
